Please read these Terms of Service (“Terms”) carefully before using FitAsia. FitAsia is published on Google Play under the developer name AInstitute and operated by Tony Chandra, an individual developer based in Tangerang Selatan, Indonesia (“we”, “us”, “our”).

By creating an account or using the FitAsia app (the “App”), you agree to these Terms. If you do not agree, please do not use the App.

1. What FitAsia is

FitAsia is a calorie- and nutrition-tracking app. It lets you log meals (including by photo, analyzed automatically using AI), track water intake, weight, and daily activity, and view your progress over time against goals you set.

2. Not medical advice

FitAsia is provided for general informational and self-tracking purposes only. It is not a medical device and does not provide medical, dietary, or health advice. Calorie, nutrition, and health estimates shown in the App — including AI-generated food analysis — are automated approximations and may be inaccurate or incomplete.

Always consult a qualified physician, dietitian, or other healthcare professional before making decisions about your diet, weight, exercise, or health, especially if you have a medical condition, are pregnant, or are managing any health issue. Do not disregard professional medical advice because of anything you see in the App.

3. Eligibility

You must be at least 13 years old to create a FitAsia account. If you are under the age required to consent to data processing on your own behalf in your country, you may only use FitAsia with the involvement and consent of a parent or guardian.

4. Your account

To use most features of FitAsia, you need an account, created with an email and password or via Google Sign-In. You agree to:

  • Provide accurate information when creating your account;
  • Keep your login credentials confidential and secure;
  • Notify us if you believe your account has been accessed without your permission.

You are responsible for all activity that occurs under your account.

5. Your content and the AI food-analysis feature

You retain ownership of any photos, entries, and other content you add to FitAsia (“Your Content”). We do not claim ownership of Your Content and do not use it for marketing or any purpose beyond providing the App’s features to you.

When you scan or upload a food photo, you grant us a limited license to send that photo to Google’s Gemini AI service solely to analyze it and return a nutrition estimate for your food log, as described in our Privacy Policy. We do not otherwise use Your Content, and we do not share it publicly.

You agree not to upload content that is unlawful, infringes someone else’s rights, or that you do not have the right to share.

6. Free to use; future paid features

FitAsia is currently free to use, with no in-app purchases or subscriptions. If we introduce paid features or subscriptions in the future, we will update these Terms to describe pricing, billing (via Google Play Billing), and cancellation before any such feature launches, and your continued use after that update will be subject to the revised Terms.

7. Acceptable use

When using FitAsia, you agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms;
  • Attempt to reverse engineer, decompile, or extract the source code of the App, except where permitted by law;
  • Interfere with or disrupt the App’s operation, servers, or networks;
  • Attempt to access another user’s account or data without authorization;
  • Use automated means (bots, scrapers, etc.) to access the App outside of normal use;
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

We reserve the right to suspend or terminate accounts that violate these Terms.

8. Deleting your account

You may delete your account and associated data at any time from within the App (Profile → Delete Account), or by following the process at fitasia.org/delete-account. See our Privacy Policy for details on what is deleted.

9. Service availability

We aim to keep FitAsia available and reliable, but we do not guarantee uninterrupted or error-free operation. The App depends on third-party infrastructure (including Google Firebase and Google’s Gemini AI service), and we are not responsible for outages or issues caused by those or other services outside our control, or by your device or internet connection.

We may modify, suspend, or discontinue any part of the App at any time. Where reasonably possible, we will provide notice of material changes that affect your use of the App.

10. Disclaimer of warranties

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, secure, or that any calorie or nutrition estimate will be accurate.

11. Limitation of liability

To the maximum extent permitted by law, AInstitute and Tony Chandra shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the App, including any decisions made based on information provided by the App. Nothing in these Terms limits liability for matters that cannot legally be limited, such as liability arising from gross negligence or willful misconduct.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date above and, where appropriate, notify you within the App. Your continued use of the App after an update constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the Republic of Indonesia, without regard to its conflict-of-laws principles.
